if i buy cue or vdj on ebay (all boxed) and some one else has the lisence can i still get the upgrades and download skins etc etc from here or would i have to buy the software from virtualdj themselves thanks

If it is a sealed never used retial package of Cue sold by a legitamate music store yes.
If it is a non sealed item or "not original cd" it is an ilegal counterfit copy and will not work and comes with no support or benifits.

The only legal source for VirtualDJ is to purchase it from our site store - http://www.virtualdj.com/buy/
As Simon mentioned, CUE can be purchased from Authorized Dealers and must be in the original package.
